King Coal in Court – May/June 09 – Sierra Magazine – Sierra Club
Those of you know how much I hate filthy fossil fuels. Most of you have read my story of having grown up in the mining and steel country of the upper Ohio Valley. This article then was of great interest to me:
As the Bush era wound down, power companies rushed to build hundreds of new coal-fired power plants. activists picked them off one by one–until a Sierra Club lawyer found a chink in the Law that just might stop them all . . .The Clean Air Act which classifies carbon dioxide a pollutant. But allowed carbon dioxide emissions from coal fired power plants.
The one and only thing the Obama administration has right: “In February, newly appointed EPA administrator Lisa Jackson announced that the agency would reconsider Johnson’s order, effectively killing it. Jackson also signaled that–finally–the EPA planned to use the Clean Air Act to regulate carbon dioxide and other greenhouse gases.”
